Review of the Infringement Case

In 2019,Colibri Heart ValveColibri Heart Valve, LLC Accuses Medtronic of Infringing Its Patent for Replacement Heart Valves. The lawsuit claims that Medtronic's CoreValve, CoreValve Evolut R, CoreValve Evolut Pro, and CoreValve Evolut Pro+ series infringe on two of its patents.

Colibri Heart ValveCause of Action: The doctor's use of Medtronic's TAVR infringes uponColibri Heart ValveThe patent, which covers a method for controlling the deployment of self-expanding artificial heart valves.

According toColibri Heart ValveDescription: ItsCEO Joseph HornMet with some managers of Medtronic in May 2014 - according to the confidentiality agreement - to discussColibri Heart ValveThe successful implementation of the TAVR product in patients, followed by a teleconference with Medtronic in July 2014,And sent a PowerPoint presentation on the patent to Medtronic in 2018.

Therefore, in 2023, a federal jury in the Central District of California found that the Evolut series of TAVR products infringedColibri Heart ValvePatent (8,900,294), and ruled that Medtronic failed to prove with "clear and convincing evidence"Colibri Heart ValvePatent invalid. The ruling requires Medtronic toColibri Heart ValvePaying $106.5 million, Medtronic immediately stated that it would appeal.

Through the appellate process, the Federal Court of Appeals overturned the original ruling this week. The court held that Medtronic is entitled to a judgment of "non-infringement of the '294 patent" as a matter of law, thereby vacating the district court’s prior dismissal of that judgment. This vacatur rendered the remaining issues on appeal moot.

A panel of three judges pointed out in the ruling that the judge of the original trial court did not confirm whether Medtronic had actually infringed.

Next, I don't know.Colibri Heart ValveWhether to continue collecting evidence and appeal.

Colibri TAVI System

Colibri TAVI SystemIt is the only truly thin transcatheter aortic heart valve, which uses dry tissue technology to achieve a pre-installed, pre-crimped, and pre-loaded heart valve.

ColibriThe manufacturing process offers significant operational, quality, and cost advantages compared to traditional "wet" technology, as it ensures controlled and precise valve crimping and placement on the delivery system, and eliminates the need for on-site cleaning, installation, crimping, and loading of the valve before use.
