New Regulations for Medical Device Complaints and Reports Implemented
Recently, the newly revised "Measures for Handling Complaints and Reports in Market Supervision and Administration" has officially come into effect, closely related to the safety of medical device use across China. The new regulations clearly standardize the procedures for complaints and reports in the medical device sector, the division of responsibilities, and the processing timelines, clearing up "bottlenecks" in the complaint and reporting process. The new "Measures" clearly define the boundary between complaints and reports: a complaint refers to a consumer’s request to resolve a rights dispute with an operator, while a report refers to the act of revealing suspected illegal leads. It lists situations that can be reported or complained about, with complaints following the principle of "report if suspicious." Meanwhile, the new regulations specify processing timelines: after receiving a complaint, market supervision departments should promptly verify and accept it; the responsible department must provide feedback within 60 days of acceptance, with complex cases extendable by 30 days. Time spent on inspections and testing is not included, ensuring swift responses to requests.
