2. Jiangsu Province Strengthens Intellectual Property Protection in the Field of Centralized Drug Procurement
Recently, the Jiangsu Provincial Intellectual Property Office and the Jiangsu Provincial Healthcare Security Administration jointly established working mechanisms for information sharing, dispute resolution, and operational safeguards to further strengthen intellectual property protection in the pharmaceutical procurement sector. When participating in centralized volume-based procurement in Jiangsu Province or applying for "sunshine listing" transactions for their products on the Jiangsu Provincial Drug and Medical Consumables Procurement Management System, enterprises must independently commit that the relevant products do not violate the Patent Law of the People's Republic of China and other applicable laws and regulations. Enterprises are responsible for the authenticity and accuracy of such commitments. If an enterprise fails to make a required commitment or submits false commitments through fraudulent means, its listing or winning bidder status will be suspended. In serious cases, the product’s listing or winning bidder status will be revoked, and penalty points will be assigned and handled in accordance with the relevant provisions of Jiangsu Province’s sunshine procurement credit scoring management system.
