Failure to record the information of implantable medical devices in the medical record as required

▌Case 1

In June 2024, health supervision and law enforcement officers in Yong'an City conducted an on-site inspection of a medical aesthetics clinic. They discovered that the clinic was using an implantable medical device, "Cross-linked Sodium Hyaluronate Gel for Injection" (commonly known as "Hyaluronic Acid"), to perform cosmetic filler procedures on patients without recording key technical parameters of the implantable medical device in the medical records as required. This action violated relevant provisions of the Regulations on the Supervision and Administration of Medical Devices. The Yong'an City Health Bureau ordered the parties to correct the illegal behavior and issued a warning as an administrative penalty.

▌Case 2

On June 6, 2024, law enforcement officers from the Shaxian District Health Bureau discovered during an on-site inspection of a medical aesthetics clinic that the clinic was using implantable medical devices (sodium hyaluronate for injection) to conduct medical aesthetic procedures without recording the relevant information of the device in the patient's medical records as required. The clinic's actions violated the relevant provisions of the Regulations on the Supervision and Administration of Medical Devices. The Shaxian District Health Bureau ordered the parties to correct the illegal behavior and issued a warning as an administrative penalty.

Relevant Laws and Regulations

1. Article 51, Paragraph 2 of the "Regulations on the Supervision and Administration of Medical Devices" stipulates that when using large medical devices as well as implantable and interventional medical devices, the name of the medical device, key technical parameters, and other information closely related to the quality and safety of use must be recorded in medical records and other relevant documentation.

2. Article 90, Item 3 of the Regulations on the Supervision and Administration of Medical Devices stipulates that in any of the following circumstances, the health authority of the people's government at or above the county level shall order corrections and issue a warning; if the violation is not corrected, a fine of more than 50,000 yuan but less than 100,000 yuan shall be imposed; in serious cases, a fine of more than 100,000 yuan but less than 300,000 yuan shall be imposed, ordering the suspension of relevant medical device use activities until the original licensing authority revokes the practice license. Relevant responsible personnel shall be ordered by law to suspend their practice activities for more than 6 months but less than 1 year, until the original licensing authority revokes the relevant personnel’s practice certificates. For the legal representative, principal person in charge, directly responsible manager, and other responsible persons of the violating entity, income obtained during the period of illegal activities from the entity shall be confiscated, and a fine of more than 30% but less than three times the income obtained shall be imposed, and appropriate disciplinary action shall be given according to law: (3) The medical device using entity fails to record information about large medical devices as well as implantable and interventional medical devices into medical records and related documentation as required.
